The Website is the exclusive property of MAKE UP FOR EVER , the sole entity authorized to use and exploit the intellectual property rights, individual rights and any other intellectual property right relating to this Website and owned by or expressly licensed to MAKE UP FOR EVER , particularly the brands, drawings, models, copyrights and image rights.

ELIGIBILITY

The purchase of Products through the Website is strictly limited to parties who can lawfully enter into and form contracts on the Internet in accordance with the laws of Kuwait.

In order to make purchases on the Website, you must provide your personal details, including your real first and last name, valid mobile telephone number, alternate contact phone number, valid e-mail address, payment details, valid billing address and other requested information as indicated. You represent and warrant that the payment details you provide are valid, complete and correct and confirm that you are the person referred to in the billing information provided.

The Website is only available to persons who meet MAKE UP FOR EVER terms of eligibility, those who hold a valid credit/debit card by a bank acceptable to MAKE UP FOR EVER , and those who have authorized us to process a charge or charges on their credit/debit card in the amount of the total purchase price for the product(s) which they purchase. Products purchased are for personal or gift use only and shall not be re-sold, used for commercial purposes or for any other commercial benefit. MAKE UP FOR EVER reserves the right to restrict multiple quantities of an item being shipped to any one customer or delivery address.

By making an offer to purchase Products(s), you expressly authorize MAKE UP FOR EVER to perform credit checks and to transmit or obtain your credit/debit card information or credit report information (including any updated information) to or from third parties to authenticate your identity, validate your credit/debit card, obtain an initial credit/debit card authorization and/or authorize individual purchase transactions, as we deem necessary. You agree that we may use personal information provided by you in order to conduct appropriate anti-fraud checks and such personal information may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

2. TERMS AND CONDITIONS OF SALE

· Placing an Order

To place an order, visitors must visit the Website and register as a user, or, instead, place the order as guests without registering as user, by filling out, on both cases the corresponding online form available at all times on the Website and following the instructions indicated on the Website.

To place an order, visitors must add the Product they wish to purchase to the shopping cart before proceeding to the checkout, following the on-screen instructions to complete and submit the order form provided.

you can order up to six (6) items of a Product.

The prices and offers appearing on the Website are valid only for online orders placed on the Website and they may not coincide with the prices and offers available from other distributors of the Products. All prices published on the Website are in Kuwaiti dinar (KWD) and inclusive of taxes (including value added tax).

By confirming an order, you expressly acknowledge and accept these Conditions as part of concluding the contract. Unless proven otherwise, the data recorded by the Website constitutes proof of all transactions carried out between MAKE UP FOR EVER and its customers. MAKE UP FOR EVER will store and provide access to the electronic document that formalizes the contract.

Once a purchase is made, MAKE UP FOREVER ’s Customer Service Department will send a purchase receipt by email as soon as possible within 24 hours after the purchase.

MAKE UP FOR EVER will issue a soft copy invoice once the order leaves our warehouses. This can be downloaded by going to the “My orders” section of the “My account” page. MAKE UP FOR EVER warns that sales invoices cannot be modified once issued, without prejudice to your right to obtain a corrected invoice in those cases provided for under current regulations. The invoice will be issued in the name of the individual or company that places the order. It is therefore important to ensure that the order is placed using the correct name.

· Product Availability

The selection of Products offered on the Website is valid as long as the Products appear on the Website, provided that MAKE UP FOR EVER has stock available. As with all ecommerce, stock is updated online. It is therefore possible for stock to run out while completing the purchase process. In such cases, it will not possible to continue the transaction that is underway.

Should a Product be out of stock or temporarily unavailable, MAKE UP FOR EVER will contact you to advise accordingly and offer a new delivery date or cancel the order if the Product cannot be delivered.

MAKE UP FOR EVER reserves the right to modify the Products appearing on the Website at any time and without notice. Notwithstanding the above, MAKE UP FOR EVER shall make its best efforts on offering the client a satisfactory alternative.

· Order Confirmation

After you confirm your order, it will be sent to MAKE UP FOR EVER for processing. You will not be able to modify or cancel your order except under those situations set forth in the Conditions or the provisions established by Kuwait law.

By confirming your order, you fully accept all the Conditions. You will be sent an email summarizing your order.

· Payment Methods

Prices for MAKE UP FOR EVER Products are indicated in KWD and are inclusive of taxes.

MAKE UP FOR EVER reserves the right to modify the prices of the Products on the Website at any time and without notice. Product invoicing will be based on the price list appearing on the Website at the time your order is confirmed, subject to the availability of the Products ordered at that time.

All orders placed on the Website must be paid for immediately when you confirm your order.

We only accept payments by cash or card on delivery Payments made through the Website will be processed online with the corresponding banking institution. The banking institution in question will be responsible for automatically storing and processing the information relative to different orders, including bank card data,

Orders must be paid for in KWD Payments must be made via Mastercard®, Visa®, or on cash on delivery. Your order will be processed once the purchase and payment processes have been fully completed.

Should any of the Products ordered not be available (see “Product Availability”), MAKE UP FOR EVER shall inform the client about satisfactory alternatives or similar products and, in case the client chooses to give up with the purchase, the amount of the undelivered Products will be refunded to the bank card used to make the purchase, on the understanding that the order has been canceled.

· Product Delivery

Delivery Address

Products purchased on the Website can only be delivered within the Delivery Zone.

Any delivery address located outside the Delivery Zone will be rejected during the order process.

Orders using a PO box as the delivery address will not be processed.

The merchandise will be sent to the delivery address within the Delivery Zone specified in the order.

Delivery Time

Deliveries will be made within 1 to 2 business days. For the count of the delivery times, the following days will not be taken into account: Friday and any bank holiday in Kuwait. Ordered Products will be delivered during normal working hours at the address provided when placing the order, provided that payment has been confirmed. No deliveries will be made until payment has been received for the Products.

Delivery Problems

Should you not receive your Product or should the delivery be delayed by more than eight (8) business days, you should contact MAKE UP FOR EVER as soon as possible by clicking on the Website’s “Contact us” tab.

In the event that there is nobody at the address provided to accept delivery of the Products, the courier company will contact you in order to agree upon a new delivery date or a location to pick up the Products.

Every effort will be made to deliver the Products as fast as possible after the order is accepted.

When the order is delivered, you must check to ensure that the shipment is correct. If there is any discrepancy or problem with your order at the time of delivery, you must indicate the nature of the discrepancy or problem (for example, open package, damaged merchandise) on the delivery note and sign it. Upon accepting delivery, ownership of the Products and all risks associated with these are transferred to the recipient.

If the Products do not correspond to your order or you are not satisfied with them, you can exchange them for others or return them for a full refund in accordance with the conditions set forth in the “Return Policy” section.

· Shipping Costs

for all orders, the shipping costs are included in the Product price.

· Cancellation & Return Policy

In the event that you change your mind after placing an order on the Website, you can cancel your order by contacting us within an hour of receiving your order confirmation and we will do our best to accomodate your request as long as the order has not begun processing for shipment.

For returns, MAKE UP FOR EVER will not refund or exchange any products unless received in defective or faulty condition, or supplied incorrectly.

In case of receiving a faulty or incorrect product, the Customer must contact us once having sent the email to the customer service so that we set up the return with our carrier.

The Products must be returned in their original state and in their complete original packaging and unopened, along with any accessories associated with the Products (promotional gifts included).

MAKE UP FOR EVER has sole discretion in determining whether the Products have been returned in their original condition. Products that are returned incomplete, broken, damaged, worn, unsealed or used by the customer will not be subject to a refund. They will be made available to the sender or sent back with postage due on delivery at MAKE UP FOREVER ’s discretion.

MAKE UP FOR EVER disclaims all liability and responsibility for any loss, shipping delay or delivery to an incorrect address of any article that you wish to return to the Website, insofar as you assume the risks associated with your chosen shipping method.The customer is responsible for obtaining proof that the Products have been returned by sending these via certified mail or by any other means that provides a receipt indicating the date the shipment was postmarked and delivered. If you exercise your right to cancel or return your order, we will refund all payments that we have received from you, including shipping costs, under all circumstances, within a maximum of fourteen (14) calendar days from the date you inform us of your decision to cancel the contract. However, we may withhold any refund until we have received the goods or until the user has presented proof that the goods have been returned, whichever condition is met first.

After receiving the Product, we will proceed with the aforementioned refund using the same payment method that was used to make the purchase. In the case of return of a cash-on-delivery order, the refund will be reimbursed via a coupon code or bank transfer. The right to cancel the contract, as laid out in this section, only applies to Products purchased exclusively from the Website and shall in no case apply to Products purchased in a physical store.

the other terms of these Terms and Conditions shall not be affected and shall remain in full force and effect.

These Terms and Conditions are reproduced in English and Arabic. If there is any inconsistency between the English text and the Arabic text, the English text will prevail.

These Terms and Conditions are governed by the laws of Kuwait and all disputes arising hereunder are subject to the exclusive jurisdiction of the Kuwaiti courts.
